Is It Legal or Illegal to Kill Possums?

Possums are the second most common animal in Australia and are often considered as pests that can threaten humans, pets, and livestock. They can also cause significant property damage if they choose to inhabit your space. However, it is crucial understand that killing possums is illegal in Australia. As per the Australian government regulations, the killing of possums is prohibited, and their removal must be handled with care. Possums may defend themselves when trapped due to their strong teeth and claws, so it is recommended to avoid attempting to remove them independently. Furthermore, removing ringtail possums requires a permit.

Native Birds

In Australia, removing native birds is generally prohibited without a special permit, as they are protected under the Nature Conservation Act 2014 and the Animal Welfare Act 1992. Interfering with native birds or their nests can result in penalties. Birds such as Long-billed Corella, Sulphur-crested Cockatoo and Galah can be controlled under certain circumstances in Victoria.

Elaboration:

  • Legal Protection:

Native birds and their nests are protected under Australian law, and it's illegal to harm, kill, or remove them without specific permits.

  • Permits and Licenses:

Special permits, not standard pest control licenses, are often required to manage native bird issues.

  • State Variations:

There are differences in regulations between states, so it's crucial to check local requirements.

  • Problematic Birds:

While native birds are protected, some species can be problematic, particularly in urban areas.

  • Managing Issues:

Managing native bird problems often involves strategies like deterring birds from certain areas or removing nests (with permits).

Kangaroos

In Victoria, the Eastern Grey Kangaroo (Macropus giganteus) and Western Grey Kangaroo (Macropus fuliginosus) can be controlled through the Kangaroo Harvesting Program (KHP) and the Authority to Control Wildlife (ATCW). ATCWs allow landholders to control and dispose of kangaroos themselves.

Authority to Control Wildlife (ATCW):

  • Landholder Control:

ATCWs are an alternative to the KHP, allowing landowners to control and dispose of kangaroos themselves.

  • Application Required:

Landholders need to apply for an ATCW, which is reviewed and approved by the Department of Energy, Environment and Climate Action (DEECA).

  • Control Methods:

ATCWs can authorize various control methods, including scaring, lethal control, and trapping.

Note: The information above is based on the current regulations and practices as of May 16, 2025. It's recommended to consult the relevant government websites (e.g., Vic GovDepartment of Jobs, Skills, Industry and Regions) for the most up-to-date details on specific requirements, quotas, and procedures.
